Can I sue an auto finance Company?
« on: November 10, 2007, 03:08:06 PM »
I was going to buy this SUV at this used car dealer, he took a downpayment from me, I left with the car, about 3 days later the salesman called me saying that a finance company approved me, I asked him well let me see and sign the contract, he said don't worry I already took careof it. I asked how, I need to sign it and review it, he said. "I took it of it"

a day later the finance company called me to review my income, bla bla bla. I asked don't i need to sign a contract, and they said, they already have it signed by me. I NEVER signed  ANYTHING, I went to the finance company to get a copy and found out that the sales person sign my name on the contract with his handwritting,  I told the finance company and dealer, they didn't do anything, I didn't know what to do and kept the car for 2 or 3 months, made a couple of payments  and then I said im not going to keep this car, legally is not my contract, i returned it and now they are asking for 8000 as a deficiency balance, voluntary repo

IF you can prove forgery, you have a case.

I'd report the forgery to the cops.  Since you did keep the car for "2 or 3 months", and "made a couple of payments" you should be liable for any depreciation because you knew about the falsity of the contract and did nothing about it as far as contacting leagal authorities.

You need to go and make a complaint through the Trading Standards Officials . Better still get a solicitor to write a letter on your behalf . Post it under Recorded Delivery. These Rogue Companies will sell your alleged Debt to Debt recovery Companies and Those Companies Employ real BAD BOYS .

Act quickly if you are to stand a ghost of a Chance.

Once you started paying, you pretty much lost most of your rights, because you showed an intent to honor the contract by paying.  You might have a case, but your big mistake was not voiding the contract immediately.  Basically, the finance company will say that you authorized the salesman to act as your agent.  Your trying to have your cake and eat it too here.
