Auto accident laws in Texas?
« on: February 04, 2008, 10:30:03 PM »
I was in a car accident today. It was the other driver's fault because he admitted to the police that he didn't see the red light and passed it. I have full coverage insurance on my car but of course he doesn't have insurance at all! I have a fairly new car (2006) and he had something like from the 80's. Now my car is almost total'd not to mention me being bruised and cut up from the impact and airbags deploying, and his car is only wrecked on the side and still driveable. Before I know it he talks to the cop & drives off with a couple tickets.  Isn't there some kind of law  that he should have got arrested since he didn"t have insurance and caused the accident?

No. Sounds like the other driver got a ticket for no insurance and probably for running the red light. Its just like speeding. They are all class C violations. You don't get arrested for the traffic violations...even if you did cause a crash and don't have insurance. Now if you don't have unisured motorist coverage then you are going to have to sue the guy to get your stuff fixed and to pay for any medical bills.
